Viramontes v. JTH TAX LLC, d/b/a Liberty Tax Service

Illinois class action on behalf of tax preparers at Liberty Tax stores who were forced to work off the clock and were not paid overtime in violation of Illinois labor laws. Moreover, Liberty Tax also required employees to clock in and out at the beginning and end of each workday by means of a biometric recognition system that took each employee’s fingerprint for a record of timekeeping that collected and stored the employees’ biometric identifiers without prior disclosure or express written consent as required by Illinois’ BIPA privacy law.
